
Registration of Society
A society is register under the Societies Registration Act, 1860, which is administered by the State Government. It is register either as a society (i.e. without the word Cooperative) or a cooperative society. The procedure for registration of a society depends upon the type of activities to be undertaken by it and the scale of operation. Further a society can register either as an ‘unlimited’ or a ‘limited’ company. A cooperative society can be registered only as a limited company and not as an unlimited company. A society can be registered under two sections – 20 & 21 of the Societies Registration Act, 1860 depending on its nature, activities and scale of operation.
Registration Under Section 20
A society can register under Section 20 where its purpose is not for commercial purposes but for promoting science, literature, charity or other useful objects for the benefit of the public or for any such object which is not carry on with any profit motive. Such societies are call non-profit orient societies and are constitute mainly to promote welfare activities in areas such as health, education, housing, child welfare etc. A minimum of seven persons are require to form such a society.
Procedure for Society Registration
- The society is register under the Society Registration Act, 1860 or the State Societies Registration Act. The society can register by a group of 7 to 11 persons and they should not be less than 18 years of age. There are certain documents need for registering a society and they are as follows:
- The application form has to be fill with the name, address and occupation of all the members
- The Memorandum of Association and Rules and Regulation of the Society has to be prepare.
- It is advisable to include a draft bye-law in the Memorandum of Association.
- The process of forming a Society is as follows:
- A minimum of 7 members are require to form a Society and file the application for registration.
- The members should convene at an open meeting and pass a resolution that they want to form a Society and elect the office bearers.
- The members then need to draft the rules and regulations of the Society, which are to be follow by its members. The rules and regulations should include the following:
- Name of the Society
- Details such as address, contact details, etc
- Objectives for which it has formed
- Details about the office bearers
- Procedure for opening bank account, approval of accounts, election procedure, etc.
List of Documents required for Registration of a Society
- The memorandum of association shall in Form A and shall sign by each member of the provisional committee of the proposed society, who shall add to his signature, his name, address, description and occupation.
- The rules of the proposed society shall be in Form B.
- A list of members.
- A declaration as to compliance with the rules regarding registration.
- A statement that the names, addresses and occupations are correct.
- A copy of any document embodying the bye-laws or instruments regulating the constitution and management of the society shall furnish with the application.
Eligibility Criteria for Society Registration
- Any seven or more individuals can form a society in India if they:
- Come together for literary, scientific, religious or charitable purpose
- Associated for performing activities under this Act
- Have no intention of making profit
